NEW MEXICO (WPDE) — The man accused of killing New Mexico State Police Officer Justin Hare will not face the death penalty.
The United States District Court for the District of New Mexico filed the notice Wednesday for Jaremy Alexander Smith.
He is charged with carjacking resulting in death, and discharge of a firearm during and in relation to a crime of violence.
Smith is accused of killing Hare on March 15 after getting a flat on I-40 near Tucumcari.
When Hare offered to give him a ride into town, NMSP Chief Troy Weisler said without warning Smith shot Hare twice and then pushed Officer Hare into the passenger seat of the patrol car as he stole the vehicle.
Smith’s criminal record includes taking hostages and rioting in jail, burglary, breaking and entering, armed robbery, resisting and evading police, auto theft, shooting at or from a motor vehicle and armed robbery.
