Nebraska Supreme Court rejects challenges to dueling abortion petitions

LINCOLN, Neb. (KLKN) – The Nebraska Supreme Court on Friday rejected challenges to dueling abortion petitions.

The lawsuits argued that the initiatives, the Protect the Right to Abortion petition and the Protect Women and Children petition, violated the state constitution’s single-subject rule.

But the Nebraska Supreme Court ruled that both initiatives don’t violate the rule.

The Protect the Right to Abortion petition seeks to make abortion a constitutional right in Nebraska.  The Protect Women and Children petition would enshrine the current 12-week abortion ban into the state constitution.

The dueling abortion petitions will appear on the general election ballot in November.  Secretary of State Bob Evnen said the initiative with the most “for” votes will become law.

Also on Friday, the Nebraska Supreme Court denied a challenge to the Private Education Scholarship Partial Referendum.

That referendum seeks to remove a program that provides state funding to private school scholarships.  It will appear on the November ballot.

The Nebraska 2024 general election ballot is required to be finalized by Friday.
