Colorado’s new ‘Deepfake’ law: A warning to voters

GRAND JUNCTION, Colo. (KJCT) – Colorado’s new ‘deep fake’ law, HB 24-1147, goes into effect 60 days after a primary election and 90 days after a general election. It is meant to protect the integrity and fairness of elections in Colorado.

Deepfakes are images, videos, audio, or other multimedia that have been doctored to portray someone falsely. Nadja Atwal, a board member of the Global A.I. Council said, “Deepfakes are basically the worst of A.I. It basically is any form of manipulation of audio, video, and images.” These are sometimes fun jokes and shared for laughs, but they have been used to deceive and scam people. Scott Baradell, CEO of Idea Grove, told us, “It is getting harder and harder to spot a deepfake, but you can generally look for poor lip-syncing or unusual facial expressions.”

In response to the rise of deepfake use, Colorado Lawmakers worked to get HB24-1147 out the door to protect voters and the integrity of Coloradan elections from political campaigns taking advantage of deepfake AI. Dr. Lisa Palm, CEO and spokesperson with DR. LISA AI, told us her thoughts on legislation like this. “I think it is necessary. Unfortunately, bad actors are not going to comply with these rules, so we are going to have to be vigilant and aware as consumers.”

Other states are pursuing legislation like HB24-1147, but the primary obstacle is ensuring that new laws do not infringe on anyone’s First Amendment rights.
