How many Democratic delegates does Oklahoma have?
Out of the 3,896 delegates heading to Chicago for the Democratic National Convention in August, the Oklahoma Democratic Party is sending 36 “pledged” delegates along with state party officials, who are known as superdelegates.
This number comes from a Democratic bylaws formula, which is based on each state’s population and percentage of the total Democratic vote.
Pledged delegates are typically required to vote for the state’s primary winner. In this case, it’s Joe Biden.
Only the pledged delegates are bound to voting for a specific candidate, barring unusual circumstances. The superdelegates are free to select any candidate but cannot cast a ballot in the first round.
How can Oklahoma delegates vote for Kamala Harris if Joe Biden won the primary?
Joe Biden received 73% of the vote during Oklahoma’s Democratic presidential primary election on March 5. This result gave him 36 committed delegates from Oklahoma, adding to the nationwide total that made Biden the presumptive nominee.
In any other historical timeline, those delegates would have to cast their nomination vote for Biden at the convention. But the president’s announcement that he will not accept the party’s nomination triggers a section of Oklahoma law releasing them of that obligation.
Title 26 of Oklahoma law requires delegates to cast their vote for the candidate who received the most votes during the primary. However, the statute also says this:
“If that candidate is for any reason no longer a candidate, the votes of the Oklahoma delegation shall be cast for any candidate of their choice.”
